The independent Cricket Discipline Commission (CDC) confirmed on Tuesday that the players had been charged with two counts of breaching ECB Directive 3.3 for their parts in an incident outside a Bristol nightclub last September.
They will face individual CDC Disciplinary Panel hearings on December 5 and 7.
However, the date of the hearing means that all-rounder Stokes will, as it stands, be able to join England on their tour of Sri Lanka.
England take on Sri Lanka in five ODIs and a Twenty20 match, for which both Hales and Stokes will likely be selected, and three Tests, in which the latter should form a pivotal part of the XI. The Test series runs until November 27.
